2018 National Infrastructure Conference

The National Infrastructure Conference is here again. Now in it's fourth year, it remains only conference focused entirely on tax issues affecting infrastructure. This year's conference will be held at the Sheraton Hotel in Melbourne from 17 to 18 May 2018.

Our conference program covers many issues that are relevant to the industry, including outbound infrastructure investment, social PPPs, anti-avoidance rule application, financing principles, valuations and a focus on economic infrastructure and trusts. Christopher Voyce from Macquarie Capital and Jeremy Hirschhorn from the ATO will deliver keynote addresses.

Our panel discussion in the session “Federal Treasury Review – Staples, Foreign Investor Concessions” is sure to be a highlight, involving lots of robust debate.

Finally, a conference dinner at the Sheraton will provide ample opportunity to catch up with colleagues from the industry, including professional firms, corporates and the ATO.

SMSF and Asset Protection from Creditor Claims

SMSFs generally provide good asset protection from creditor claims, in particular, the protection of benefits. Although, it is not all smooth sailing, as, like any asset owner, SMSF trustees can be subject to creditor claims and must therefore consider asset protection strategies. This session will examine these issues, including:

  • When and how contributions can be clawed back
  • How benefits are protected from creditor claims and when they can be at risk
  • How SMSF assets can be attacked and protected
  • The effect of bankruptcy of a member on an SMSF

Presenter: Phil Broderick, CTA, Sladen Legal

Phil Broderick, CTA, is a principal of Sladen Legal and heads its Superannuation team. He is member of a number of superannuation-related committees. This includes being the chair of The Tax Institute’s Superannuation Committee and the chair of SISFA’s Technical Committee. He is also a member of number of the ATO’s superannuation liaison groups, including the Superannuation Industry Relationship Network (SIRN) and the Superannuation Industry Stewardship Group (SISG). He is also heavily involved in liaising with Treasury and the ATO in relation to the implementation of new superannuation laws and administrative practices. Phil is listed in the 2020 Best Lawyers for Superannuation Law in Australia. Phil’s areas of practice include superannuation, estate planning and succession, duties and state taxes, trusts, federal tax and business structuring. He is a regular author and presenter. His articles have featured in The Tax Institute’s Taxation in Australia journal and CCH’s Super News. He has presented at seminars and conferences conducted by The Tax Institute, the Television Education Network, Legalwise and various accounting bodies.
