The Emerging Leaders Tax Discussion Session provides a forum for the next generation of industry leaders to further engage with The Tax Institute member network and develop technical and professional skills.

Session Topic: Structuring for Property Development

Given the ever-evolving property environment, this practical case study based session will consider structuring property ownership arrangements including exploring:

  • Ideal ownership structures for acquisition and development, including development for sale versus development for rent and revenue/capital account considerations.
  • Use of rollovers to convert long term passively held property into a structure appropriate for development.
  • Use of bare trusts to avoid double duty on subdivision arrangements.
  • Issues for SMSFs in developing property.

Amy Liu, CTA, HWL Ebsworth
Amy is a Senior Associate at HWL Ebsworth lawyers, and is experienced in advising clients across both direct and indirect taxation, with expertise in mergers & acquisitions, corporate structuring, private equity, real estate and cross-border investments and transactions. Amy's practice also involves liaising with revenue authorities in relation to tax controversy matters. Amy is a finalist in the 2021 and 2020 30 under 30 Lawyers Weekly Award, and a finalist in the 2020 Tax Institute's Emerging Tax Star Award.

Thomas McKenzie, Ashurst
Thomas is a lawyer at Ashurst assisting the team on income tax matters, with a particular focus on funds establishment, real estate, mergers and acquisitions, and financial arrangements. His experience includes tax structuring, tax due diligence and the taxation aspects of legal documentation.

Adam Crowley, ATI, RSM Australia
