State taxes: a review and observations on recent trends

Helen Symon QC and Catherine Pierce identify recent decisions and trends in payroll tax, land tax and duty cases, including what they revel about the taxpayer’s onus of proof. In the payroll tax context, they consider the reach of the “contractor provisions” and recent consideration of factors guiding the Commissioner’s grouping discretion. In the primary production land context, they discuss what it means to have a “principal business” and identify challenges associated with proving that land is used primarily for primary production. Finally, Helen and Catherine will also consider who is a “foreign purchaser” for the purposes of the Duties Act.

Helen Symon QC, Victorian Bar

Helen Symon QC is one of the most experienced taxation silks in Australia, practising in both an advisory and a disputes context across the full range of tax law. Her unique input in advisory matters stems from her extensive experience in court. Helen appears regularly in the High Court of Australia, the Federal Court of Australia and the Supreme Court of Victoria, representing both taxpayers and revenue authorities alike. Reflecting her extensive experience in commercial and administrative, as well as tax matters, Helen is regularly named in Best Lawyers and asked to speak on a range of topics. Her style in written and oral advocacy has been, variously, described as elegant, sophisticated, subtle and accomplished.

Catherine Pierce, Victorian Bar

Catherine Pierce practises primarily in federal tax, in respect of direct and indirect taxes, and in various aspects of state tax litigation. Recent federal tax cases in which Catherine has appeared include: Federal Commissioner of Taxation v Thomas (2018) 264 CLR 382 (led by Justin Gleeson SC and Philip Looney QC) and Commissioner of Taxation ats Glencore Investment Pty Limited [2019] FCA 1432 (led by Kristina Stern SC). Recent state tax cases in which Catherine has appeared include: Commissioner of State Revenue ats Kelima Pty Ltd [2019] VCAT 404 and Commissioner of State Revenue ats Nationwide Towing Services Pty Ltd [2018] VSC 262 (led by Chris Horan QC). Before joining the Bar in 2012, Catherine was employed as a solicitor in Hong Kong where she advised in respect of international financial instruments.
