All you wanted to know about Trusts but were afraid to ask

Trusts are used widely in commerce, wealth management and succession planning. The rules governing trusts are complex as they are found in key principles developed over centuries of court decisions together with increasingly more focussed statutory regimes and nowhere is this complexity more apparent than in the intersection of the law of trusts and the income tax laws.

In this session, Terry Murphy QC and Daniel Diaz will explore some of the intersections of the general law of trusts and the income tax law such as:

- Section 100A and family dealings.

- Trusts and the Family Law Act 1975 (Cth): Rollovers, Division 7A, renunciation and exclusion.

- When dotting the “i”s and crossing the “t”s is not enough: The doctrine of sham.

- Capital distributions: The CGT aftermath.
