Sisyphus and His Rock: Sorting Myth from Reality in Dealing with Tax Audits and Disputes
The aim of this session is to assist tax practitioners to effectively manage and navigate tax disputes. The session will provide an overview of the scope and nature of the Commissioner’s powers during an audit and powers of assessment. It will also provide an overview of the scope to challenge an assessment. It will focus on recent developments and some of the more difficult areas for a taxpayer, including:
- - The ATO’s information gathering powers
- - The need, and how best, to prove your case
- - The issuing of assessments and the ‘fraud or evasion’ problem
- - The onus and standard of proof
- - Penalties.
